Miranda for Terrorists?
As Dear Leader Obama closes Gitmo and now has to decide where to place the people there (either within the US or elsewhere) concerns are being expressed about rights for these terrorists under the Miranda Warning.
If they are brought to US soil, will they be authorized protection under the Miranda Act?
The Miranda Warning states:
“You have the right to remain silent.
Anything you say can and will be used against you in a court of law.
You have the right to an attorney.
If you cannot afford an attorney, one will be provided for you.
Do you understand the rights I have just read to you?
With these rights in mind, do you wish to speak to me?”
Lets break these rights down a bit and see how they could apply to terrorists.
You have the right to remain silent. Okay that’s obvious duh! But then jump down to Do you understand the rights I have just read to you? Now law enforcement officers first have to determine what language the terrorist speaks. Arabic? Pharisee? You get the point. So before an officer can even mirandise a suspect, they have to figure out what language they speak.
Then they have to find a translator in that language.
But do they really understand their rights? Language translation can be suspect and can the officer understand if the rights are even being translated with the proper meaning of the warning?
Land minds everywhere.
But the main question here is: Do non-American citizens have rights under Miranda?
When police officers within the United States arrest someone, they are to mirandise them. If later they determine they are illegal, the rights stand. BUT, when you know that a person your talking to is not an American citizen, wants to do harm to American citizens, do they have the same rights?
I’m not the only one with these concerns. Robert Spencer is the director of Jihad Watch. He fears Dear Leader Obama could adopt a policy that could seriously hinder soldiers on the battlefield because of the Miranda warning.
“It creates an absurd situation because then we’re facing the prospect of people being arrested on the battlefield and read their Miranda rights. And then people who are fighting wars — soldiers — will have to decide whether or not they can take action against the enemy or whether they will have to let them go because they won’t be able to prove their case against him in a civilian court,” he explains. “So it creates a ridiculous situation that will ultimately lead to military defeat.”

Most of you know that the SGM(r) spent a year in Afghanistan. I can pretty much tell his thoughts on this. NO - They have no rights given to Americans on American soil.

Jo,
I agree with the SGM(r). Of COURSE Miranda rights don’t apply to terrorists. The Third Geneva Convention doesn’t even apply to terrorists, since they do not meet Article 4.1.6 (although we as a nation should still treat them as humanely as possible).
